1. Introduction

Welcome to Mr FiXiT, a contractor-on-demand platform connecting clients with verified service professionals across South Africa and abroad.
These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Platform”).
By using the Platform, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws.
If you do not agree, please do not access or use the Platform.

2. Definitions

• Client: A user seeking repair, maintenance, or home-improvement services.
• Contractor / Service Provider: A verified individual or business offering such services through the Platform.
• User: Any person using the Platform, including Clients and Contractors.
• Job / Booking: A service request initiated and accepted through the Platform.
• Account: A personal or business profile registered on Mr FiXiT.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements.
Contractors must hold all required trade licences, certifications, and permits relevant to the services they provide.

4. Account Registration

To access most features, you must create an account and provide accurate, complete, and current information.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Mr FiXiT may suspend or terminate accounts for false information, misuse, or security violations.

5. Our Services

Mr FiXiT provides a digital platform that:
• Enables clients to post service requests and obtain quotations;
• Allows verified contractors to accept or bid on jobs;
• Facilitates secure in-app communication and cashless payment; and
• Offers rating and feedback mechanisms for quality assurance.
Mr FiXiT is not the contractor nor the client—we act solely as a facilitator between independent parties.

6. Service Fees and Payments

• All payments between Clients and Contractors are processed through the Platform’s secure gateway.
• Mr FiXiT charges a service or booking fee (typically 15%) on each completed job.
• Contractors authorise Mr FiXiT to deduct this fee automatically prior to payout.
• Refunds or disputes will be reviewed in accordance with our Refund & Dispute Resolution Policy (available separately).
• Mr FiXiT may adjust fee structures with reasonable notice to users.

7. Contractor Responsibilities

Contractors agree to:
• Perform all work with due skill, care, and professionalism;
• Comply with applicable laws, health & safety standards, and trade regulations;
• Honour accepted bookings and avoid cancellations without valid cause;
• Maintain appropriate public-liability insurance; and
• Refrain from soliciting clients outside the Platform for any job initiated through Mr FiXiT.
Failure to meet these obligations may result in suspension or permanent removal.

8. Client Responsibilities

Clients agree to:
• Provide accurate job descriptions and access information;
• Ensure a safe working environment for contractors;
• Review and approve completed work promptly;
• Make full payment for completed services; and
• Refrain from abusive or fraudulent behaviour on the Platform.

9. Cancellations and Refunds

Cancellations must be communicated through the Platform before work commences.
Refunds, where applicable, will be handled per our Refund Policy and may take up to 7 business days.
Once a contractor has begun work, refunds are limited to verified service-failure cases.

10. Dispute Resolution

If a dispute arises between a Client and Contractor, Mr FiXiT will act as a neutral facilitator.
We may request supporting documents, chat logs, or photographic evidence.
Our resolution decision will be final within the context of the Platform.
Parties remain free to pursue external remedies under South African law.

11. Prohibited Activities

Users may not:
• Violate any law or third-party rights;
• Post false, misleading, or defamatory content;
• Circumvent Platform fees or payment processes;
• Engage in harassment, discrimination, or abuse;
• Upload malware or attempt to compromise system security;
• Use bots, scrapers, or automated tools without consent.

12. Intellectual Property

All content, trademarks, software, and materials on the Platform are owned or licensed by Mr FiXiT.
Users may not reproduce, distribute, or modify any portion of the Platform without prior written consent.
Contractors retain ownership of their professional trademarks and service images uploaded to their profiles.

13. Data Protection

Mr FiXiT processes personal information in accordance with its Privacy Policy and applicable data-protection laws (POPIA and GDPR).
By using the Platform, you consent to such processing and to our cross-border data-transfer mechanisms where necessary.

14. Limitation of Liability

To the maximum extent permitted by law:
• Mr FiXiT provides the Platform “as is” and makes no warranties, express or implied.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform or services provided by contractors.
• Mr FiXiT’s total aggregate liability shall not exceed the total fees paid by the user in the 3 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Mr FiXiT, its directors, employees, and affiliates from any claims, losses, damages, or costs resulting from your:
• Violation of these Terms;
• Misuse of the Platform; or
• Infringement of any third-party rights.

16. Termination

Mr FiXiT may suspend or terminate your account at any time for:
• Breach of these Terms or any policy;
• Fraudulent or unlawful conduct; or
• Prolonged inactivity.
Upon termination, access to the Platform and stored data may be restricted or permanently removed in accordance with data-retention laws.

17. Amendments

We may revise these Terms periodically to reflect operational or legal updates.
The most recent version will always be available on our website with the effective date clearly indicated.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa, with recognition of Mr FiXiT’s international operations based in the United Kingdom.
Any disputes will be subject to the jurisdiction of the High Court of South Africa (Western Cape Division), unless otherwise mutually agreed.
